16th September, 1943.

I am comanded by the Army Council to inform you that they have had under con-ideration the question of damage by acts of war in theatres of war overseas in which British Troops are qurating, and to state that despite the policy of adhering as closely as possible to the laws of the country concerned in the investigation and settlement of olains made by the civil population, the Council will not assume res asibility in respect of damage, whether accidental or not, resulting from all or any of the foll wing acts or operations:

(a) lotion of any kind whatsoever taken by the enemy.

(b) ction taken by the 11ied Forces in operations against the enemy or

what is believed to be the enemy.

(0) Destructive measures carried out by the Allied Forces for the purpose of denying to the enemy access to or use of goods, installations, properties or prunises of ɛny kinʊ whats ever.

(d) The evacuation of persons or property carried out by the Allied Forces

for the purp se of denying to the enemy access to or the use of the services of such persons ar property.

(•) ¡recautionary or preparatory measures including the destruction of

buildings or crops, te flooding of land, the adaptation of land to military purposes or other interferences with property or persons taken by the Allied Forces, in order to prevent, hinder or destroy any anticipate action by the enamy.

(f) Measures taken by the Allied Forces to mitigate the effect of or to

avoid the spreadin of the consequences of all or any of the types of the actions specified above.

Claims arising from such acts or operation: ill therefore be repudiated and 10 payment will be made.
